Guarantee and Repair Terms

1. Scope of the Guarantee

1.1 Without prejudice to the warranty claims to which the Customer is entitled, Dickert Electronic GmbH (hereinafter referred to as the Guarantor) shall offer the Customer a two-year guarantee of durability on the acquired object of sale, limited to the Guarantor's delivery and dispatch area. The guarantee shall contain an obligation of liability on the part of the Guarantor for defects in the object of sale that occur within the guarantee period.

1.2.1 No guarantee shall be deemed to apply if the Customer himself or a third party has caused the defect in the object of sale by repairing the object of sale or if the defect is due to technical interference or mechanical, thermal or chemical damage or damage to the object of sale caused by inappropriate or improper use or treatment of the object of sale by the Customer himself or third parties.

1.2.2 A guarantee in relation to the object of sale shall generally be excluded if markings, particularly date markings, have been removed, modified or rendered unrecognizable.

1.2.3 Furthermore, parts of the object of sale that are subject to consumption (for example, batteries) or normal wear and tear (for example, inscriptions) shall be exempt from this guarantee. Any and all defects that are caused by incorrect installation and commissioning shall also be exempt.

1.2.4 The delivery and return of the sent products (to which objections have been raised) shall be carried out at the Customer's risk and expense. In particular, any costs, such as the Customer's carriage, transport, labour and material costs in respect of other consequential costs and damages, specified under section 439(2) of the Bürgerliches Gesetzbuch (German Civil Code - BGB), shall not be reimbursed by Dickert Electronic. Only in the case of justified and significant consequential costs of the defect (net > €100) shall the Contractor make a contribution of up to 20% of the total costs. This shall not apply to consequential damages.

2. Guarantee Period

2.1 The guarantee period shall commence as of the date marking affixed to the object of sale.

2.2 The date marking shall be affixed to the product in the form of a 4-character digit (week + year) and shall be made up as follows:
Digit 1 + 3 = calendar week
Digit 2 + 4 = year                     
Example: 0150 = week 05 year 10 = 2010.
Notwithstanding the above, the date of manufacture is affixed in plain text to some products on account of statutory provisions.

 

3. Claiming the Guarantee

3.1 The customer may claim the guarantee from the following address:

3.2.1 The Customer shall enclose a copy of the invoice with the consignment in addition to the object of sale in order to facilitate assignment of the object.

3.2.2 The Customer shall enclose with the object of sale an exact description of the defect in writing; failing this, any necessary repair cannot be carried out. In such a case, the Guarantor may return the object of sale to the Customer at the latter's expense.

3.2.3 In the event of a guarantee, the Customer shall, at the Guarantor's option, receive the object of sale back either in the form of a free repair or a free replacement.

4. Terms of Repair

Defective products that do not fall within the warranty or guarantee, as well as products free of defects, can also be repaired or tested and calibrated by Dickert Electronic GmbH for a corresponding charge in accordance with the current repair price list.

The products received for repair or testing shall be deemed to be a repair order by Dickert Electronic GmbH. As repair billing is carried out in accordance with the current repair price list, no cost estimate shall be provided. The products received shall be tested and, if required, repaired and calibrated. Damaged or defective parts shall be replaced. Parts that are subject to normal wear and tear, e.g. handheld transmitter housings, shall be exempt therefrom.

If a repair is inappropriate (water damage, corrosion, short-circuit, severe mechanical damage etc.), the item shall be returned directly. No repair costs shall be charged in this case.
